Guideline for IFT Seal on approved devices for telecommunications or broadcasting.


IFETEL published the Guideline for the use of the IFT Seal on approved devices for telecommunications or broadcasting on December 26, 2023. The guideline will be enforced in 180 (one hundred and eighty) business days after its publication in the Official Gazette of the Federation.


IFT Seal specifications:


The holder of a Certificate of Homologation, subsidiaries, and importers, must use the IFT Seal, as the specifications established as below:


1. The IFT Seal must be printed in 100% black or 100% negative black, respecting the protection areas and minimum printing dimensions as defined in Figure 1 as below.

2. The IFT Seal must be legible without the magnification, and easily visible to the end user, considering the minimum printing dimensions.

 

3. The IFT Seal proposal must be provided when applying for the Certificate of Homologation.

 

 

Permanent marking or labeling of the IFT Seal:

 

In the marking or labeling of the approved products, the IFT Seal must be included, in addition to the prefix "IFT" in capital letters and the Homologation Certificate number as shown in the figure 2 as below.

 

 

It is not mandatory to include the IFT Seal in the marking or labeling of those products that have been approved prior to the enforcement of the Guidelines as well as the products for which the process to obtain their Certificate of Homologation has been initiated prior to the enforcement of the Guidelines.

IFETEL classifies the 5925MHz-6425MHz as unlicensed band


 

IFETEL officially published the regulation which classifies the frequency band 5925MHz-6425MHz as unlicensed band on the Official Gazette of the Mexican Federation on March 7, 2023.


The regulation establishes technical operating conditions of the frequency band 5925-6425 MHz and is enforced since the publishing date.


∙ The identification of unlicensed band for the 5925MHz-6425MHz segment, which is a part of the internationally known band for 6GHz, will allow its use by the general public without license or authorization by the Institute.


∙ The 500MHz of spectrum at the low end of the 6GHz band will allow to offer new services with the technology known as WiFi-6E in Mexico.


∙ With the allocation of this segment, the amount of spectrum will double for the provision of Wi-Fi services in the country, adding to that of the 2.4GHz and 5GHz bands that are already used by these systems.


∙ With this classification, the short and medium term demand can be met for unlicensed band for communications with Wi-Fi technology as well as other technologies that occupy that type of spectrum.

 


It is important to highlight that within the operating conditions of this unlicensed band, its use was determined for indoor low power systems and indoor as well as outdoor very low power systems.

IFETEL New type approval procedure



Following on from our news published on June 28, 2022, we would like to remind that the new type approval procedure were already started from June 27, 2022. Here we would like to notify you the certificate validity:


After the enforcement of the new type approval procedure, the IFETEL certificate for Type B and Type C is issued with lifetime validity, and 90 days before two years after issuance date of the certificate (21 months after issuance date), the renewal application must be submitted to keep the lifetime validity. Previously, the provisional IFETEL certificate was with 1 year validity, and after the renewal, it was issued with lifetime validity.


Remark: All the provisional certificates that were approved before June 26, 2022 were given 1 year grace period to submit the renewal application before its expiry date to remain the same IFETEL ID number as before.



If there is a provisional certificate that has expired, it has to be processed as a new application with new IFETEL ID number.

IFETEL New type approval procedure


IFETEL published an updated type approval procedure for telecommunication products, dated December 29, 2021, which mentions that below identifies could be the certificate holder:


1. Each local Importers/ distributor, dealer or wholesaler.

2. Manufacturer’s affiliates or branch office/ Main control of distributor, dealer or wholesaler.


For the product which obtains both NOM and IFETEL certificates by Manufactures’ affiliates or branch in Mexico that Main control of their importers/ distributor, dealer or wholesaler, additional importer/ distributor, dealer or wholesale can be listed to the NOM and IFETEL certificates to import, sell and operate the product, and all the products will label with same IFETEL certificate number and NOM logos.


For the product which obtains IFETEL certificate only (process by perito, Mexican professional engineer), additional importer/ distributor, dealer or wholesaler cannot be listed to the IFETEL certificate. However, all the importers, dealers, or wholesale will be able to import, sell and operate the product as marked with the same IFETEL certificate number.


IFETEL grants a transition period of 180 days after its publication on December 29, 2021, which will be June 26, 2022

In the same document, it also mentions the new IFETEL label requirement as follows:


 

Each Approved Product must have a physical or electronic marking or labeling, which must contain at least the following: 1. The number of the obtained Homologation Certificate. 2. The Type Approval Certificate number must be preceded by the prefix "IFT" in capital letters on a single line and must be legible without the aid of magnification. In addition, the aforementioned information may be provided on the packaging and/or in the manual.

Mexico -New Conformity Assessment Procedure

 

IFETEL published New Conformity Assessment Procedure on the Mexico Official Gazette on February 25,2020, which requires the holder of the Certificate of Conformity for NOM-208-SCFI-2016 being the real importer. Besides, the Certificate of Conformity , testing report and IFETEL certificate must be under the same holder (real importer). It will be enforced after 365 days of its publication. Local rep service will be no longer available. 


We would suggest that any new application from now on should be for the real importer.

 

We expect IFETEL may clarify more details when the time is closer to the enforcement date (February 25, 2021).

Mexico / IFT-012-2019 SAR Technical Standard


On February 26, 2020, Instituto Federal de Telecomunicaciones (IFETEL) published a new technical standard for SAR, IFT-012-2019, on Official Gazette (DIARIO OFICIAL), which will take effect 365 days after the publication date.

 

The technical standard is applicable to:

 

Products, equipment or devices with radio frequency transmitter or transceiver, make use of radio spectrum or connect to a telecommunications network in the frequency range from 30 MHz to 6 GHz and that are used:

 

a) Near the head, particularly near the ear, in the frequency range of 300 MHz to 6 GHz, and / or

 

b) At a distance less than or equal to 200 mm from the human body, in the frequency range from 30 MHz to 6 GHz.

 

This regulation is NOT just limited to devices with WWAN function. It is applicable to any kind of product with RF function that has contact with the human body up to 200mm. So this includes desktops, laptops, headphones, etc.

 

 

At this moment, there is no accredited lab and certification body for this standard. We will provide more details when it is available.

Mexico- Extension for NOM certificates examine at the customs


 

Following up on the announcement published by the Ministry of Economy (SE) in the Official Gazette of the Federation (DOF) on October 23, 2018 and its extension on February 28, 2019, starting from June 3, 2019, HS code needs to be listed on NOM certificates which will be checked in the Mexican Customs. In an urgent case, Certification Body (NYCE) can provide expedite service with extra cost to reprint NOM certificate with HS code in one day. 

 

For new applications:

The SE published another extension, document No. 312.2019.01.1363 on May 15, 2019.  The document states that it is an exceptional to import products without NOM certificates as long as the type approval request has been sent to Certification Body and Testing Laboratories before May 31, 2019. Certification Bodies and Testing Laboratories shall issue the acknowledgment of receipt with the corresponding samples or applications and submit it to the Mexican customs system for customs clearance. 

 

The announcement is valid for 90 days after the publication date of the notice.

Mexico- HS codes added to NOM certificates


According to the announcement published by the Ministry of Economy (SE) in the Official Gazette of the Federation (DOF) on October 23, 2018 and its extension on February 28, 2019, starting from June 3, 2019, HS code needs to be listed on NOM certificates which will be checked in the Mexican Customs. Therefore, all the valid NOM certificates that will be used by the importer in the customs must be re-issued to include the HS code. The importers must make sure to use the correct HS code,  otherwise the products will be stuck in customs until the certificates are revised.

NOM-208 certificate is required at the customs

 

On October 23, 2018, the Mexican SECRETARY OF ECONOMY published an agreement on Official Gazette (DIARIO OFICIAL), which updates General Rules and Criteria for Foreign Trade, and it will be enforced on October 24, 2018.

The agreement states that some NOM certificates are required to be verified for the product importation at the Mexican customs, including the certificate of conformity for NOM-208-SCFI-2016 for radio communication systems using spread spectrum technique, frequency hopping and digital modulation, and operating in the bands 902 MHz-928 MHz, 2400 MHz-2483.5 MHz and 5725 MHz-5850 MHz.

Mexico / New NOM-029-ENER-2017 for energy efficiency for external power supply

 

New NOM-029-ENER-2017 for energy efficiency for external power supply is published on Oct. 27, 2017 on the DOF (Diario Oficial de la Federación). It will be enforced on April 25, 2018, after 180 days since the publication date.

This regulation is applicable for products that will be sold with external power supply, such as AC adapter, POE, etc. and for external power supply that will be sold alone.

NOM-029-ENER-2017 clearly states the limits, testing methods, marking and labelling for energy efficiency approval for external power supply.

 

In addition, following up on the last news for energy efficiency approval (CONUEE) on June 15, 2017, the new regulation is officially published on Nov. 14, 2017 on the DOF (Diario Oficial de la Federación). Catalogue for the devices which require energy efficiency approval (CONUEE) is updated. The new regulation will be enforced on January 13, 2018, after 60 days since the publication date.

 

For the products listed on the CONUEE new catalogue, CONUEE approval is required.  However, the product will be sold with  AC adapter which requires NOM-029-ENER-2017 certificate, then the product does not require CONUEE testing nor approval.

Mexico Energy Consumption approval is temporarily stopped until new law is published

 

Due to the publication of the Energy Transition Law (Ley de Transición Energética – LTE) and enacted on May 4, 2017, the old law for Sustainable Use of Energy (Ley para el Aprovechamiento Sustentable de la Energía – LASE) and its regulations were cancelled by the National Commission for Efficient use of Energy (CONUEE). 

 

There will be some changes as below:

 

CONUEE will publish a catalogue listing equipment which requires power

   consumption approval on its website. The catalogue will be updated every two

   years.

 

The new LTE no longer requires the power consumption for idle mode.

 

The approved devices will be published on the DOF (DIARIO OFICIAL DE LA

   FEDERACIÒN) and the website of CONUEE.

Mexican Standard NOM-208-SCFI-2016 was officially published on Feb. 08, 2017.


Mexican Standard NOM-208-SCFI-2016, which replaces the expired, temporary Mexican Standard NOM-EM-016-SCFI-2015, was officially published in Mexico’s official gazette DOF on February 08, 2017.  After 60 day calendar days of its publication, it will be enforced. The certificates issued under previous regulation NOM-121-SCT1-2009, NOM-EM-016-SCFI-2015 and IFT-008-2015 are still valid. 

 

The manufacturers which already obtained certificates of conformity under NOM-121-SCT1-2009 and NOM-EM-016-SCFI-2015 can request the certification body to re-issue the certificates of conformity under NOM-208-SCFI-2016.

Mexico RF/TELCOM Authority has changed the name from COFETEL to IFETEL.

Mexico COFETEL(La Comisión Federal de Telecomunicaciones) has already changed the name from COFETEL to IFETEL. As the IFETEL is still under the process for the structure change, the implementation date is not officially announced and decided yet. This change will not impact products approved by COFETEL. In the future, product approved under IFETEL’s name will have to go with IFETEL’s label.

 Mexico Now Doing Customs Check for NOM approved devices

In the latest official journal (Diario Oficial de la Federación) published on Dec. 31, 2012, by Mexico’s telecommunications authority, Cofetel, some changes have been made to the regulation surrounding official Mexican norms (NOMs). Effective immediately, devices falling under the categories and frequencies of NOM-121 and NOM-151 will be checked at customs to ensure the necessary approvals have been passed. In the past, though NOM-121 and NOM-151 were required, they were only enforced through market surveillance. They will now be enforced at the port of entry.

 

Additionally, the 5470-5725MHz frequency band is now officially allowed for unlicensed use and must pass Cofetel approval to be sold in the country. This frequency band does not require local testing through NOM.

Lab Accreditation and COFETEL Approval Under NOM121

 

 
Mexico’s COFETEL has officially started approval for NOM121-SCT1. The applicable frequency bands that require NOM121-SCT1 approval are 902-928MHz, 2400-2483.5MHz and 5725-5850MHz. 

COFETEL had previously published the regulation for NOM121-SCT1 on June 22nd, 2010, to be enforced starting August 21st of that year. However, at the time testing labs had not yet been accredited to have the authority to run the tests necessary to enforce NOM121-SCT1.
 
Since then, testing laboratories have passed all requisites for testing accreditation, and were accredited by COFETEL as well as the EMA (Entidad Mexicana de Acreditación – Mexican Accreditation Entity). They now have the authority and capability to run sample testing related to NOM121 certifications, and testing and certification for NOM121 will be fully enforced.
