Letter No. 429/2023

 


ANATEL published the new Official Letter No. 429/2023 on Nov. 11, 2023, which reiterates that all testing reports (done in Brazil or abroad) must follow and meet the previous Act 4083 requirements, including the traceability information. 


Act 4083 stipulates in item 6.3.1.5 that before starting the testing either in Brazil or abroad, the manufacturer or applicant MUST formally report to the OCD (Certification Body) the following:


I - The manufacturing unit where the sample was produced; and

II - The traceability of the sample submitted for testing.


The most important point of new Official Letter No.429/2023 is that from now on, it will NOT be accepted testing report done abroad before the OCD’s pre-validation of the traceability and approval.


According to Act 7280, ANATEL accept foreign reports for some specific products, such as non-RF Network switch for corporative/ industrial use, OLT, Digital Multiplexer, Coaxial cables, some types of Optical cables, Satellite transceivers and some others.


Due to this new Official letter No. 429/2023, foreign laboratory MUST only start testing after OCD’s approval.


P.S.: It is mandatory for FCC (or CE) testing lab be ISO/IEC 17025 accredited since ANATEL only accept testing reports from accredited labs.

Act. 13423 amends Act. 5159



Following up on the Act 5159 published on April 29, 2022 which updated testing requirements for Mobile Phone Charger, ANATEL published Act 13423 on October 14, 2022, which amends Act 5159.


According to the new Act 13423, the old Act 3481 will not be revoked until October 21, 2023, and the Act 5159 will be enforced after October 21, 2023.


Between October 26, 2022 and October 21, 2023, charger manufacturers can choose either the requirement approved by Act 3481/2019 (Old Act) or requirement approved by Act 5159/2022 (New Act).

Official letter nº 265/2022 extend the time range of certificates’ validity date for renewal process



On July 26, 2022, ANATEL published the Official letter nº 265/2022 to extend the time range of certificates’ validity date for renewal process. Due to the remaining impact of COVID-19, ANATEL decided that all certificates with expiry date between March 6, 2020 and October 31, 2022 are exempt from doing renewal testing and providing new external/internal photos as long as the device does not suffer any modification.

ANATEL published the new Act. 5159 with testing requirements for Mobile Phone Charger on April 29, 2022. The new Act. will be enforced in 180 days (October 26, 2022) to replace the actual Act. 3481.


The main changes are as follows:


1) USB interfaces that integrate the electrical/electronic design do not requireANATEL approval (such as TV, computer, Multimedia central, etc.);


2) For Vehicular Chargers, the ESD tests must be applied in accordance with Item8.3 of ISO 10605/2008 (previously, it was referring to IEC 61000-4 Electrostaticdischarges must be applied to the following levels:


a)2 kV, 4 kV and 6 kV for contact discharges; and

b)4 kV, 6 kV and 8 kV for air discharges.


3) For Vehicular Chargers, the surge and transient immunity testing must beperformed in accordance with ISO 7637-2/2004;


4) For USB type built-in Vehicular Chargers, ANATEL will accept the ESD (ISO10605/2008), surge and transients (ISO 7637-2/2004) testing reports done in the 1stpart or 2nd part laboratory (manufacturer’s laboratory, for example). The laboratorymust be accredited by ILAC or evaluated by the certification body.


5) The use of Security Seal (MINT label) will be optional for built-in VehicularChargers sold along with the Vehicle. If the manufacturer chooses not to use theMINT label, the device must have the ANATEL marking in its label, such as ANATELID: HHHHH-YY-FFFFF;


6) Removal of safety testing for built-in Vehicular Chargers;


7) Removal of Voltage Dips/variation (IEC 61000-4-11) immunity testing.

Brazil ANATEL MINT label for built-in vehicle chargers will be optional


Brazil ANATEL released the draft Act. 7789242 on April 8, 2022, informing the MINT label for built-in vehicle chargers which will be optional according to item 9.1.1 in the draft Act.

 

Item 9.1.1. The Security seal described in the caput is optional for the built-in vehicle chargers supplied with the vehicle. However, the equipment must bear the identification of Anatel homologation in one of the forms provided for in the Operating Procedure for Marking the Identification of Anatel Homologation in Telecommunications Products.

 

Also, the Act. will be enforced after 180 days of its publication as mentioned below in Art. 3. Art. 3 This Act enters into force 180 (one hundred and eighty) days after its publication in Anatel's Electronic Service Bulletin. We will provide a further update once the ANATEL released the official new Act. later in the year.

Public consultation No. 47 to update Act 3481

 

Brazil authority, ANATEL, released the Public Consultation No. 47 to update the Act 3481 for requirements and testing procedures for mobile phone chargers.

 

The main changes are:

 

1. Security seal: MINT label will be optional used in vehicular chargers installed inside the car panel. This may eliminate the need of MINT labels for the vehicular chargers. In addition, if manufacturers decide not to use the MINT label, they will need to include the ANATEL ID in the charger label (regular marking).

 

2. Vehicular chargers: ESD testing will be performed according to ISO 10605/2008 instead of IEC 61000-4-2 as previous.

 

3. ESD (ISO 10605) and Electrical transient (ISO 7637-2) testing applied exclusively for USB type vehicular charger installed in the car panel or other parts of the vehicle.

Brazil- WiFi 6E (6GHz) Public Consultation No. 82/2020


ANATEL released the Public Consultation No. 82/2020 on December 11, 2020 for updating the Act 14448 (Technical Requirements For Assessing Conformity Assessment of Restricted Radiation Equipment). The purpose for this consultation is to include testing methods and limits for the 5925-7125 MHz band, which allows the certification for WIFI 6E technology in Brazil.

  

The deadline for the public consultation is January 24, 2021.

Brazil- Act. 7280 replaces Act 2220


ANATEL published the new Act 7280, dated November 26, 2020, which updated the Reference List of Products for Telecommunications and replaced the Act. 2222, dated April 20, 2020.

This new Act will be enforced after 180 days of its publication (after June 1, 2021).


The main changes are:


•  All products that previously required renewal every 1 year, now the renewal will be every 2 years, such as Chargers for mobile phone (including Wireless Charger), ONTs, WWAN devices, Mobile phones, batteries, IP phones, and so on. There will be no more renewal for every 1 year;

•  ANATEL will require ISO Certificate with sworn-in translation in Portuguese for all Certifications, except for those products whose Conformity Assessment Mode is “Conformity Declaration”;

•  ANATEL will accept testing report done abroad for some type of devices, such as OLT, Data Network Equipment (Switch) installed in corporative/ industrial environment, Digital Multiplex, and so on. The foreigner laboratory must be accredited by one ILAC member.

•  Some types of products previously not required any renewal, now they will need renewal every 3 years, such as OLT, Data Network Equipment (Switch) installed in corporative/ industrial environment, Multiplexer, Coaxial cables, some types of Optical cables, and so on.

Brazil- Act 4776 updated Act 14448 Technical Requirements of Restricted Radiocommunication Equipment

 

ANATEL published the new Act 4776 on Sep. 1, 2020 which supplemented and updated the Act 14448 for the Technical Requirements for Conformity Assessment of Restricted Radiocommunication Equipment.

 

The updates are summarized as follows:

 

VEHICLE RADAR:

 

             1) 46.7 GHz - 46.9 GHz:

  1. Electromagnetic field variation sensors is prohibited from the publication of this Act.
  2. The manufacture, import, sale and installation are prohibited from January 1, 2022.
  3. Devices already installed or in use can operate according to previously issued approval.
  4. The certification processes that started before the enforcement of this Act may be approved.

 

            2) 76 GHz - 81 GHz (previously 76 GHz-77 GHz):

  1. Power Limits:
    AVG EIRP ≤ 50 dBm
    Peak EIRP ≤ 55 dBm
  2. Spurious Emissions:
    From 9kHz to 40 GHz (refer to Res. 680 Table II)
    From 40 GHz to 200 GHz ≤ 600 pW/cm²
    Above 200 GHz ≤  1000 pW/cm²

 

             3) UWB Vehicle Radar using in 22 GHz - 29 GHz range is forbidden.

  1. 22-29 GHz UWB Radar is prohibited from the publication of this Act.
  2. The manufacture, import, sale and installation are prohibited from January 1, 2022.
  3. Devices already installed or in use can operate according to previously issued approval.
  4. The certification processes that started before the enforcement of this Act may be approved.

 

Equipment operating in the 5150 MHz - 5350 MHz band:

 

  1. AVG Conducted Power ≤ 1W (5150-5250 MHz)
  2. AVG Conducted Power ≤ 250 mW (5250-5350 MHz), if the maximum gain of the antenna does not exceed 6 dBi.
  3. AVG Power Density ≤ 50 mW/MHz

 

Newly added technologies:

 

  1. LEVEL DETECTION EMITTER-SENSOR: 76 GHz - 81 GHz
  2. VEHICLE COMMUNICATION SYSTEM: 5850 MHz - 5925 MHz
  3. WIRELESS MULTIGIGABIT SYSTEM: 57 GHz -71 GHz

Brazil- New operational procedures published by ANATEL



Following up on the release of ANATEL eight new Acts. 4077, 4081, 4082, 4083, 4084, 4085, 4088 and 4091 on July 31, 2020 for Operational Procedures to complement the Resolution 715, here we would like to point out the important changes about the Act. 4088 for ANATEL Label Marking. The new Act. 4088 will become in force and replace Act. 2221 in 180 days after the publication date. 

 

There are now 4 ways to identify ANATEL label:

 

  1. Anatel Seal ( ANATEL Logo and Homologation Number)
  2. Word “ANATEL” followed by the Homologation number( “ANATEL HHHHH-AA-FFFFF or “ ANATEL: HHHHH-AA-FFFFF”)
  3. E-label
  4. QR code

 

If you choose to use e-label, the product is intended for end users and consumers, the marking on the product packaging is also necessary. (Item 6.6)

If you choose to use QR code, it is required to have the ANATEL marking on the product packaging (Item 7.3). Also, the user must be able to read the QR code using his phone’s camera without any special software (Item 7.2) and the following information must be shown to the user (Item 7.1). 

 

I - homologation code;

II - model name and commercial name (if any) of the approved product;

III - batch number;

IV - serial number;

V - software version, when applicable;

VI - identification and address of the manufacturing unit; and

VII - identification and address of the supplier.

Brazil/ ANATEL Resolution 726



ANATEL published new resolution 726 on May 5, 2020, which announces new frequency allocation to allow the use of new technologies in Brazil


See below the new permitted frequencies and their possible use: 

 

1)      5.9 GHz to 7.1 GHz for WI-FI 6E 

2)      5.850 to 5.925 GHz for 802.11p (V2X)

3)      57 to 71 GHz for 802.11ad

4)      76 to 81 GHz for radar systems.

 

The new resolution will be enforced on September 1, 2020. Testing requirement for the new technologies/ bands are still under development.

ANATEL-Act. 2220, Act. 2221, Act. 2222


 

The new Resolution 715 for Conformity Assessment and Homologation of Telecommunications Products became effective as of April 22, 2020. However, due to the COVID-19 pandemic, ANATEL had to postpone the Public Consultation of the Operational Procedures as the guidelines for the operations of new Res. 715. Therefore, ANATEL published three new Acts to keep the Res. 715 in force.  

 

Below are about the new Acts and the main changes:

 

1) Act. 2220(April 20, 2020):

  • There is no more Product division by categories (I, II, III);
  • Certification is now based on 3 schemes:

TYPE 1 scheme - Certification based on Local Testing. This scheme does not require renewal. (as the rules for previous Category III).

TYPE 4 scheme - Certification based on Local Testing with Periodic Product Evaluation (periodic renewal) according to the Telecommunications Products Reference List (as the rules for previous Category II).

TYPE 5 scheme - Certification based on Local Testing with Periodic Product Evaluation (periodic renewal) and the Factory Management System (as the rules for previous Category I).

 

2) Act 2221(April 20, 2020):

  • E-Label is acceptable.
  • ANATEL logo is now optional in the marking. It is possible to use the simplified marking (ANATEL: HHHHH-AA-FFFFF) for all devices, not only for the small size devices as before.
  • Devices with neither enough space nor other certification markings (such as FCC), can waive the marking in its label, and include it in the manual by the ANATEL’s approval.

     

3) Act 2222(April 20, 2020):

This is the new list of Telecom products require mandatory ANATEL approval. As there is NO more Category I, II, III divisions as before, this document is basically a Table with all devices which were listed inside the previous Category lists. In general, nothing is changed for the type of devices.

ANATEL published an additional document (Official letter 157/2020) with an orientation about the COVID-19


 

On March 12, ANATEL published an additional document (Official letter 157/2020) with an orientation about the COVID-19 renewal exception. In this new letter, ANATEL states that only the certificates with due date between March 6 to June 30, 2020, can use this exception.

Brazil- ANATEL New Act. 3481 and Act. 3482 

 

 

ANATEL (AGÊNCIA NACIONAL DE TELECOMUNICAÇÕES) published the new Act. 3481 and Act. 3482 on May 31, 2019.

 

The Act. 3481 repeals the Act. 493 for mobile phone chargers.  The technical requirements and test procedures remain the same.

 

The Act. 6482 abolishes the Official Letter IG 10 (the guidance for supplying the ANATEL MINT Label for lithium batteries and chargers used in mobile phones). The main changes are as follows:

 

1. Previously, ANATEL required that all MINT label suppliers should have a commercial representation office in Brazilian city (the capital of Brazil). In this new Act., ANATEL removes this obligation.

2. New Act. updates the ANATEL ID on MINT label to 5-2-5 digits format as it is.

ANATEL (AGÊNCIA NACIONAL DE TELECOMUNICAÇÕES) published the new Act. 1379 on February 28, 2019

 

 

ANATEL (AGÊNCIA NACIONAL DE TELECOMUNICAÇÕES) published the new Act. 1379 on February 28, 2019 to update the Act. 14448 for the Technical Requirements for Conformity Assessment of Restricted Radiocommunication Equipment.

 

The main changes for the new Act. 1379 are as follows:

 

1.     Item 6.2.5: Periodic transmissions at predetermined regular intervals are only permissible in supervisory or scan transmissions to determine the systemic integrity of transmitters used in security or safety applications. In this case, the total duration of transmissions does not exceed more than two (2) seconds per hour for each transmitter.

 

This change is aligned with FCC part 15C.231 (a), point (3). Previously, in the Act. 14448, the total duration of transmission does not exceed more than one (1) second per hour for each transmitter.

 

 

2.     Item 13.1: The frequency range for 13.11-14.01MHz is subdivided into 13.11 – 13.36MHz, 13.41 – 13.553MHz, 13.553 – 13.567MHz, 13.567 – 13.710MHz and 13.710 – 14.01 with the limit of the fundamental field strength respectively.

Brazil /Under resolution 680, ANATEL published new Act. 14448 to update the Act. 11542

 

ANATEL published new Act. 14448 on January 2, 2018 to replace the ANNEX I of Act. 11542 which the technical requirements are described. According to Act.14448, additional tests for radiated emissions (CISPR 22) and immunity for radio frequency disturbances (IEC 61000-4-3) will be required for category II products, such as Wi-Fi, Bluetooth devices, Wireless Keyboard, Wireless Mouse, Car Keys, etc. But local OCD and test labs are still working the proposal to ANATEL to finalize the technical details.

 

The new Act. 14448 will be enforced after 90 days since the publication date. For the existing certificates which are closer to the expiry date, new testing items are not required if the renewal application is uploaded to ANATEL before April 2, 2018. If the renewal application is processed after the enforcement date, April 2, 2018, new test and technical limits might be applicable.

Brazil/ New Regulation No. 680/2017/ Restricted Radiation Radio Communication

 

ANATEL published the new Resolution No. 680/2017 on June 27th which applied to Restricted Radiation Radio Communication Equipment (Unlicensed Devices: WIFI, BT, RFID, 2.4GHz SRD and many others). This new resolution will replace the actual Resolution 506/2008 within 60days.

 

The new Resolution 680/2017 is just a law that establish dates, definitions, bands where the use of restricted radiation is not allowed, since the technical contents with the frequency bands, limits and all other technical information will be published in another document before the revoke of the Resolution 506/2008.

 

Until now, nothing changed and ANATEL is aware that there are several certification process running and according to them these ongoing projects will not be impacted. New projects can still use the ANATEL Resolution 506/2008 without problems.

 

We know that ANATEL is aligning this new resolution to allow new technologies (like WPC and UWB), but no technical details was published until now.

The Resolution No. 662 was approved by ANATEL on March 8, 2016 and updates the previous Resolution No. 242 which was established on November 30th, 2000. The new format of the ANATEL number will be HHHHH-AA-FFFFF. EAN number and bar code are no longer required on the labels.

Brazil’s ANATEL Reinforces Rules for End User Devices Containing Previously Approved Modules

 

In an official letter released by ANATEL, the authority has informed that end user devices listed in the compulsory homologation list (as well as tablets, even if they are not listed) will from now on undergo rigorous checking to make sure modules contained in the products are correctly approved and provided by the certificate holder of the approved model. Only modules provided by the original supplier will be considered officially approved for use within new end user devices. Said modules must be properly labeled to show ANATEL ID information.

 

As before, end user devices are required to show the following information on their user’s manual and packaging: “This product contains the board XXX, ANATEL homologation code NNNN-YY-MMMM.”

 

If an end user device cannot prove the contained modules are properly homologated, labeled, and provided by the original certificate holder, the module’s homologation  will not be accepted for the end user device, and will need to undergo new testing & new homologation of the end user device to be compliant.

Brazil’s Brazil Operators to Take Measures Against Uncertified Mobile Phones

 

Working together with ANATEL, several of Brazil’s biggest mobile phone operators will start taking measures to disable mobile phones on their network that have not been certified by ANATEL. By keeping track of IMEI numbers of all new phones in service, this new system will hopefully stop low quality phones and forged brands from entering the country, as these will now be blocked from accessing mobile phone service through providers such as Oi, Claro, Vivo, and Tim.

 

This system will only affect new phones entering the market starting mid-2013, and will not affect phones already in operation in Brazil.

Brazil’s ANATEL’s new testing laboratory requirements

 

Starting October 2012, samples sent to testing labs in Brazil will no longer be allowed to be modified at the laboratories themselves in order to conform to test standards.

 

Previously, local testing labs have been able to modify or add components to test samples in the case where samples failed a certain test standard, with the manufacturer’s promise that said changes would be made to the production line as well. ANATEL has concluded that this type of modification in labs compromises the validity and reliability of the testing and certification process.

 

ANATEL has therefore announced that effective immediately, any sample that fails a test standard must be sent back for modifications to be made by the manufacturer directly, before being sent back to the labs for testing. Any standards that may be affected by these changes shall be retested for confirmation.

 

Additional testing costs may vary based on the type of failure and which items must be retested.

Brazil ANATEL strike over

On the evening of September 5th, Brazil’s telecommunications authority, ANATEL, sent out an announcement that the regulatory agency’s strike is now over. The issues have been internally resolved and the full workforce will be back to their duties starting immediately. Internal actions will be taken to find resources to recover the time lost during the strike.
